Cook County judge to rule on Illinois same-sex marriage Friday

A Cook County judge on Friday is expected to make a decision on whether to allow a lawsuit to continue that challenges Illinois' ban on same-sex marriage. Same-sex marriage advocates -- Lambda Legal and the ACLU -- filed lawsuits on behalf of 25 same-sex couples challenging the constitutionality of an Illinois law that bans gay and lesbian couples from marrying. The Thomas More Society has filed a motion to dismiss the legal challenges. The judge is expected to rule on whether the lawsuits can continue. They are Darby v. Orr and Lazaro v. Orr. Ultimately, if same-sex marriage advocates are successful in their constitutional challenge, it could take the pressure off the Illinois General Assembly from having to take legislative action. The Illinois Senate passed a bill legalizing same-sex marriage last February. The Illinois House last session recessed without calling the measure for a vote.
